FLUENCY DOG TRAINING - TERMS OF SERVICE

Year One Puppy Training Program

By enrolling in the Fluency Dog Training Year One Puppy Training Program ("the Program"), you ("Member," "you," or "your") agree to be bound by these Terms of Service ("Terms"). Please read them carefully before enrolling.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using the Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Program.

2. PROGRAM ACCESS & MEMBERSHIP

2.1 Membership Tiers

The Program offers three membership tiers:

Tier 1: Self-paced access to all training content and resources
Tier 2: All Tier 1 benefits plus bi-monthly live group coaching sessions and community access
Tier 3: All Tier 2 benefits plus private one-on-one coaching sessions

2.2 Access Duration

Monthly subscriptions provide access for as long as your subscription remains active and paid
Paid-in-full memberships provide access for 12 months from the date of purchase
Access is non-transferable and limited to the individual who purchased the membership

2.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials
You may not share your account access with others
One account = one user only
Sharing login credentials or accessing the Program from multiple devices simultaneously may result in account suspension

3. PAYMENT TERMS

3.1 Subscription Payments

Monthly subscription fees are automatically charged to your payment method on file on the same day each month
You authorize Fluency Dog Training to charge your payment method for all applicable fees
All fees are in U.S. Dollars (USD)

3.2 Payment Plans

If enrolled in a payment plan, you agree to complete all scheduled payments
Access to the Program is contingent on maintaining current payment status
Enrollment is not considered complete until all payments are successfully processed

3.3 Failed Payments

If a payment fails, we will attempt to process the payment up to 3 times over a 14-day period
You will receive email notifications of payment failures
If payment cannot be processed after all retry attempts, your access will be suspended
A grace period of 5 days is provided during which you may update your payment information
Access will be restored automatically upon successful payment
Fluency Dog Training is not responsible for any missed content, coaching sessions, or learning opportunities during suspension periods due to payment failure

3.4 Price Changes

Fluency Dog Training reserves the right to change membership prices at any time
Current members will receive 30 days advance notice of any price increases
Price changes do not apply to paid-in-full memberships already purchased

4. CANCELLATION & REFUNDS

4.1 Monthly Subscription Cancellation

You may cancel your monthly subscription at any time from your account settings or by contacting us at FluencyDog@gmail.com
Cancellations take effect at the end of your current billing cycle
You will retain access through the end of your paid period
No partial refunds are provided for unused portions of the monthly subscription

4.2 Paid-in-Full Membership Cancellation

Refund requests must be submitted in writing to FluencyDog@gmail.com within 30 days of purchase.
After 30 days, paid-in-full memberships are non-refundable
Refunds are issued to the original payment method within 10 business days

4.3 No Refunds for Violations

No refunds will be provided if your account is terminated due to violation of these Terms

5. INTELLECTUAL PROPERTY & COPYRIGHT

5.1 Ownership

All content within the Program, including but not limited to:

Video training modules
Written materials, guides, and PDFs
Worksheets, checklists, and ebooks
Audio recordings
Images and graphics
Training methodologies and curriculum structure

...is the exclusive property of Fluency Dog Training LLC and is protected by U.S. and international copyright laws.

5.2 Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Program content solely for your personal, non-commercial use in training your own dog(s).

5.3 Prohibited Uses

You may NOT:

Record, screenshot, download, copy, reproduce, or distribute any Program content
Share your login credentials or allow others to access your account
Use Program content for commercial purposes or to train other people's dogs professionally
Modify, adapt, translate, or create derivative works from Program content
Remove copyright notices, watermarks, or proprietary markings
Teach, train, or coach others using Fluency Dog Training methods or materials without express written permission
Upload or share Program content on social media, YouTube, or any other platform

5.4 Enforcement

Violation of intellectual property rights may result in:

Immediate account termination without refund
Legal action seeking damages and injunctive relief
Reporting to appropriate authorities

6. COACHING SESSIONS

6.1 Live Group Coaching (Tier 2 & 3)

Bi-monthly live coaching sessions are scheduled in advance
Session dates/times are subject to change with reasonable notice
If you cannot attend live, recorded replays are available in the Replay Vault
Coaching sessions are for general guidance and do not replace professional veterinary or behavioral consultation for serious issues

6.2 Private Coaching (Tier 3)

Private coaching sessions must be scheduled in advance based on availability
Cancellations or rescheduling requests must be made at least 24 hours in advance
No-shows or late cancellations (less than 24 hours notice) forfeit that session
Private coaching is valid for the duration of your active membership only

6.3 Conduct During Sessions

Members are expected to be respectful and courteous during all coaching sessions
Disruptive, abusive, or inappropriate behavior may result in removal from the session and/or account termination

7. COMMUNITY GUIDELINES

7.1 Community Spaces (Tier 2 & 3)

Access to community discussion boards and spaces is a privilege, not a right.

7.2 Acceptable Use

✓ Share your puppy training experiences and questions
✓ Support and encourage fellow members
✓ Stay on topic (puppy training and dog-related discussions)

7.3 Prohibited Conduct

Harassment, bullying, or disrespectful behavior
Spam, advertising, or self-promotion
Sharing others' personal information
Rehoming or advertising pets

Posting illegal, offensive, or inappropriate content
Promoting other training programs, products, or services
Medical or veterinary advice (defer to licensed professionals)

7.4 Enforcement

Violations may result in warnings, temporary suspension, or permanent account termination at Fluency Dog Training's sole discretion.

8. DISCLAIMERS & LIMITATIONS

8.1 Educational Content Only

The Program provides general dog training education and guidance. It is NOT:

A substitute for professional veterinary care
A substitute for in-person behavioral consultation for serious aggression or behavioral issues
A guarantee of specific training outcomes

8.2 Dog Training Results

Results vary based on individual dogs, consistency of training, owner commitment, and other factors
Fluency Dog Training makes no guarantees regarding specific behavioral outcomes
You are responsible for your dog's behavior and safety at all times

8.3 Assumption of Risk

Dog training involves inherent risks, including but not limited to dog bites, injuries, and property damage. By participating in the Program, you assume all risks associated with training your dog.

8.4 Veterinary & Medical Issues

Always consult a licensed veterinarian for health, medical, or serious behavioral concerns
Fluency Dog Training does not provide veterinary or medical advice
If your dog displays aggression, severe anxiety, or other concerning behaviors, seek professional in-person evaluation

8.5 External Links

The Program may contain links to third-party websites or resources. Fluency Dog Training is not responsible for the content, accuracy, or practices of external sites.

9. LIABILITY LIMITATION

9.1 No Warranties

THE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUENCY DOG TRAINING LLC, ITS OWNER, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL FLUENCY DOG TRAINING'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR YOUR MEMBERSHIP IN THE 12 MONTHS PRECEDING THE CLAIM.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless Fluency Dog Training LLC from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

Your use of the Program
Your violation of these Terms
Your dog's behavior or actions
Any injury or damage caused by your dog

10. PRIVACY & DATA

10.1 Personal Information

Your use of the Program is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 Communication

By enrolling, you consent to receive:

Transactional emails (payment confirmations, access information)
Program updates and coaching session reminders
Occasional promotional emails (you may opt out of promotional emails at any time)

11. MODIFICATIONS TO PROGRAM & TERMS

11.1 Program Changes

Fluency Dog Training reserves the right to:

Modify, update, or discontinue any aspect of the Program at any time
Add or remove content, features, or coaching sessions
Change the structure or format of the Program

We will make reasonable efforts to notify members of significant changes.

11.2 Terms Changes

These Terms may be updated from time to time. You will be notified of material changes via email or notification within the Program. Continued use of the Program after changes constitutes acceptance of the revised Terms.

12. TERMINATION

12.1 By You

You may terminate your membership at any time by cancelling your subscription or ceasing to use the Program.

12.2 By Fluency Dog Training

We reserve the right to suspend or terminate your access to the Program at any time, with or without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Abusive or disruptive behavior
Non-payment
Any reason at our sole discretion

12.3 Effect of Termination

Upon termination:

Your access to the Program will be immediately revoked
You will lose access to all content, coaching, and community spaces
No refunds will be provided except as outlined in Section 4
Sections of these Terms that by their nature should survive termination will remain in effect (including intellectual property, liability limitations, and indemnification)

13. GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fluency Dog Training regarding the Program.

13.2 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Diego County, California.

13.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.4 Waiver

Failure by Fluency Dog Training to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

13.5 Assignment

You may not assign or transfer your membership or these Terms without our prior written consent. Fluency Dog Training may assign these Terms at any time without notice.
